By using EarthQuest, a service operated by Stamm Software, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please refrain from using EarthQuest.
1. User Responsibility and Safety
EarthQuest is a tool designed to encourage exploration and activity. However, your safety, conduct, and interaction with the real world remain entirely your own responsibility. The coordinates provided by EarthQuest are generated randomly and do not come with any guarantee of safety, accessibility, or legality of access.
By using EarthQuest, you agree that you are solely responsible for:
- Exercising Your Own Judgment: Always assess your surroundings and the safety of a location before attempting to reach it. Do not enter areas that appear unsafe, unstable, or hazardous.
- Obeying All Laws: You must comply with all local, state, and national laws. This includes, but is not limited to, traffic laws, regulations on loitering, and laws concerning private and public property.
- Respecting Private Property: A generated coordinate may fall on private land. You must not trespass. Never enter private property without the landowner's explicit permission. A location on private property is considered unreachable unless you have lawful access.
Stamm Software shall not be held liable for any personal injury, property damage, legal fines, or any other negative consequences that may result from your actions while using our service. You are using EarthQuest at your own risk.
2. Acceptable Use
EarthQuest is intended for personal, non-commercial, and recreational purposes only. Its goal is to provide a fun incentive to be active and explore your environment safely and legally.
Users agree not to:
- Use EarthQuest for illegal or harmful activities.
- Attempt to reverse engineer, interfere with, or disrupt the service.
- Use automated bots or scraping tools to extract data from EarthQuest.
3. Liability Disclaimer
EarthQuest is provided "as is" without any warranties. Stamm Software is not liable for:
- The quality, accuracy, accessibility, or safety of the randomly generated coordinates.
- Errors, interruptions, or downtime of the service.
- Any loss, damage, or consequences resulting from the use of EarthQuest.
We reserve the right to modify, suspend, or discontinue the service at any time, with or without notice.
4. Governing Law
EarthQuest is operated from Germany, and these Terms are governed by the laws of Germany, excluding conflict of law principles. Any disputes arising from these Terms or the use of EarthQuest shall be subject to the exclusive jurisdiction of the courts in Germany.
5. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will provide notice by updating the date at the top of this page. Your continued use of EarthQuest after the changes take effect constitutes acceptance of the updated Terms.
